Estate Planning

Estate Planning Services

Probate is the process of filing and validating a will in court. The probate process also pays the debts and taxes owed by the deceased before dividing the estate’s assets according to the will or Mississippi estate law.

Probate courts have numerous responsibilities:

  • Transferring property titles to heirs
  • Validating wills
  • Admitting the will to probate
  • Recording the will
  • Hearing objections
  • Appointing executor
  • Providing documents allowing executor to handle estate accounts
  • Insuring that the executor follows the terms of the will
Our probate lawyers can advise you if you need help with the probate proceedings. The executor is required to publish in the newspaper notifying potential creditors so they may come forward and file their claim against the estate; otherwise the Creditor's claim may not be paid by the estate.

We will assist the executor with the collection of assets, payment of expenses and transfer of property from the estate.

Jackson probate litigation

When a will dispute becomes complicated, it may be necessary to go to court.  Our Jackson probate attorneys have experience handling probate litigation cases.

You must have standing to bring suit in the probate matter.  To have standing, you must meet at least some of these requirements:

  • Have an interest in the will
  • The provisions of the will are adverse to you
  • Named in the will or should have been
  • Would have received assets if the testator died without a will

In addition to having standing, you have to meet the requirements necessary to contest a will.  Our probate attorneys at Glover Russell, P.A., explain in detail how you must raise valid concerns about the validity of the will or probate process and challenges to the estate plan or actions of the executor or administrator.

Probate litigation may be appropriate when the deceased owed you a debt at the time of his or her death.  The probate court addresses claims against the estate and the judge will hear your claim from your probate lawyer.  The judge will then order the estate to pay your claim or invalidate your claim if it is unsupported.

Our Jackson probate attorneys will work with you to bring a claim in probate court.  We advocate your claim and provide the quality legal services you need in a friendly, professional environment you can trust.
