Estate Planning
Estate Planning and Wills

Mississippi law requires that every administrator or executor probating an estate must be represented in court by an attorney. Creating a proper estate plan and probating the estate can be a confusing and complex process. Our estate planning lawyers at Glover Russell, P.A., provide advice and assistance to our clients during the entire probate process. The executor is responsible for determining assets of the estate, paying claims probated against the estate and ultimately distributing the remaining assets to the beneficiaries. This often involves transferring assets from the estate into a trust created under the will.
We will assist the executor in carrying out their duties under the will and Mississippi Law, as well as attend all hearings. This includes preparing the petition to open the estate, assisting with the identification and gathering of assets, payment of expenses, filing estate tax returns and assisting the executor in performing their fiduciary duties. Our representations will continue through all stages of the probate process, including discharging the executor, closing the estate and distributing the assets according to the will.
